In the event that you are a business and you are claiming against another business, you can also claim compensation and interest under the Late Payment of Commercial Debts (Interest) Act 1998.

STAGE 2 – Issuing Court proceedings
Claims up to a value of £100,000.00 are issued via Money Claim Online (MCOL). This streamlines the court process for straightforward debt claims, reducing paperwork and aiming to speed up the early stages of litigation.

If a matter is complex or requires numerous supporting documents to be exhibited when the claim is issued, we advise drafting, filing and serving separate particulars of claim. Our fees for this service generally fall between £250.00 and £500.00 + VAT. For claims valued above £100,000.00 or where the issues are especially complex or preparation is likely to be extensive, a higher fee may be charged. You would be notified of this in advance of issuing proceedings.
Timescale
A defendant must respond to a claim form within 14 days of the day of service
(or particulars of claim if served separately). The day of service is taken as 5 days after the
issue date on the claim form.
If the defendant does not respond within the required timeframe, you may request judgment by default for the amount claimed on the claim form.
Where the defendant files an acknowledgement of service indicating their intention to defend, this will extend their response period from 14 to 28 days.
If a defence is received, the timescales will depend on the particular Court, the value and complexity of the debt. We will keep you advised of progress throughout the case.
